A Windhoek construction company is threatening legal action against Chez Ntemba management for defaulting over N$100,000 payment for tendered work at the new premises, the former Kongoma club in Windhoek.
Nandjoval CC sought legal advice in a default matter after Chez Ntemba management allegedly failed to pay an outstanding balance of N$118,909 for construction and renovations carried out at their new premises. The new premises have been under construction since last year March and a new subcontractor has taken over the project. Informanté is in possession of documents detailing the expenses incurred by Nandjoval Enterprises, who are now demanding that the money be paid to them citing the new subcontractors have less work than they did. “We want the money owed to us for the work done. We told them our lawyers are now involved in the matter to which they rudely replied that the court will take three years to prosecute them. Is that not ignorance and selfishness,” said the source. In a notice of default sent to the club management, Nandjoval CC is demanding a full payment of the entire outstanding balance stating legal action would ensue if they fail to meet their demands by 26 February 2011. The source further alleged management was not consistently paying and buying building materials, saying the delay hampered the works by months because the club management was running out of money to pay the day to day costs. Club Manager Hirsh Siamwanda declined to comment and referred all queries to another manager, only identified as “Tongwe”. “I cannot say anything on the matter but I suggest you call Tongwe who is there in Windhoek,” Siamwanda who claimed to have been in Gobabis said. When contacted Tongwe also declined to comment saying he was busy.
