Trigger happy officer free after docket disappeared PDF Print E-mail

A Windhoek man, Fillemon Henguva, shot in the mouth by a City Police officer last year,  still has the bullet stuck in his neck.

The officer, Lukas Joseph who was arrested and granted N$2,000 bail walked out of the Katutura Magistrate’s Court a free man on Monday when all charges against him were withdrawn after the disappearance of the docket.
Henguva, whose left cheek is still swollen, said part of his jaw and teeth had to be removed as a result of the damage caused by the bullet.
“I was also retrenched from my job as a driver with Cross Country Carriers. Although I can still drive, I’m jobless,” Henguva said.
Henguva’s case has since been taken over by the Legal Assistance Centre (LAC), who filed a lawsuit against the City Police for over N$1 million in damages.
The amount could change if Henguva undergoes further medical examinations to determine the possibility of his recovery.
When contacted for comment, Director of the LAC, Norman Tjombe confirmed handling the case and said they are really concerned that a docket can get lost just like that.
“The LAC took the matter up with the Prosecutor General and the Inspector-General of the Namibian Police demanding that they investigate how the docket went missing,” Tjombe said.
He said they asked that the case should resume since the witnesses are still available and can be subpoenaed to give evidence.
“The incident happened last year and it will not be difficult to get hold of the witnesses because they are known to our client and the police,” said Tjombe.
If the Prosecutor General is not willing to prosecute, Tjombe said, Henguva will initiate private prosecution.
